STOK Ski School Terms and Conditions
setting out the terms for bookings made online and the rules that apply at STOK Ski School
("Terms and Conditions")
1. General provisions – glossary:
1.1. Terms and Conditions – this document, which sets out the rules for online services, booking conditions and the terms of your contract with us, including the rights and obligations of both parties.
1.2. Training Lesson – a training service from STOK’s offer connected with the leisure (recreation) of the Client or a person indicated by the Client, performed on the date specified in the Contract and in the set number of Training Hours within that Training Lesson by STOK through an Instructor from STOK’s staff available at that time, appointed by STOK. Within the Training Lessons, Private Lessons and Group Lessons are distinguished. A Training Lesson begins and ends at the times indicated in the Booking, and therefore the Training Participant should ensure that they arrive at the training location sufficiently in advance.
1.3. Private Lesson – a private Training Lesson carried out by one Instructor for one person, unless the Client purchases the “second person” or “third person” option – provided that these options are available and feasible in the given case having regard to the skills and level of advancement of those persons – in which case the training service will be carried out simultaneously for those persons by one Instructor. The Client’s indication in the Booking of a specific Instructor for a given Private Lesson constitutes the Client’s preference which – insofar as possible and subject to that Instructor’s availability at the time of provision of that service – will be taken into account when STOK designates the Instructor for that Private Lesson. This means that a Private Lesson may be conducted by an Instructor other than the one indicated in the Booking, or by different Instructors. It is hereby clarified that the person of a specific Instructor does not constitute the subject-matter of the Contract, and STOK ensures that every Instructor designated by STOK holds appropriate qualifications to conduct a Private Lesson.
1.4. Group Lesson – a lesson delivered by at least one instructor:
a) for adult Group lessons (18+) – minimum 2 participants;
b) for children's ski Group lessons (under 18s) – minimum 3 participants;
c) for children's snowboard Group lessons (under 18s) – minimum 2 participants.
In the case of Group Lessons there is no possibility to indicate a preference as to the person of the Instructor; however, it is possible to submit a request for the persons indicated in the Booking to be assigned to the same group. This request constitutes the Client’s preference which – insofar as possible, depending on the availability of places in the given group and on the skills and age of the persons indicated in the preference, which should correspond to the level of advancement and the age bracket of that group – will be taken into account when assigning persons to a given group. The assignment is made by STOK on the basis of the age and skills of the given person. If the skills of a given person are lower than the level of the group to which the person has been assigned, STOK is entitled to transfer that person to a group corresponding to that person’s age and current skills.
1.5. Training Hour – 1 Training Hour is 55 minutes. This means that 2 training hours are 110 minutes, 3 training hours are 165 minutes, etc. Training Hours within a Training Lesson are provided directly one after another or on separate dates/times, depending on the arrangements between the Client and STOK (e.g., in the case of a package of Training Hours).
1.6. Instructor – a qualified member of our team who'll deliver your Training Lesson. All instructors hold relevant qualifications (such as SITN PZN certificates or equivalent) for the lessons they teach.
1.7. STOK – the ski school operated by the company under the business name Maciej Kolasa Szkoła Narciarska “STOK” spółka komandytowa (a limited partnership) with its registered office in Zakopane (KRS: 0001004571, NIP: 7352909799, REGON: 523762759), email:
biuro@szkolastok.pl, tel.: +48 (18) 26 54 280. STOK provides services by electronic means in accordance with the Terms and Conditions – which simultaneously constitute the rules within the meaning of Article 8 of the Act of 18 July 2002 on the provision of services by electronic means. These Terms and Conditions are made available free of charge via the Website: szkolastok.pl or feriezestokusiem.pl, which enables obtaining, reproducing and recording the content of the Terms and Conditions. The addresses of STOK offices can be found at szkolastok.pl.
1.8. Client – a natural person, including a Consumer within the meaning of Article 22(1) of the Civil Code, who is at least 13 years of age, provided that where such person has not attained majority, the consent of their legal representative is required if required by law, unless the contract being concluded is of the nature indicated in Articles 20–22 of the Civil Code; as well as a legal person and an organisational unit not being a legal person to which a statute grants legal capacity – who concludes a Booking/Contract with STOK using a means of distance communication. The Client, as well as a person using the functionalities of the Website, are service recipients within the meaning of the Act on the provision of services by electronic means in respect of services provided by electronic means within the meaning of that Act. The Client is obliged to inform the Training Participants indicated by them in the Booking about the rules arising from the Terms and Conditions and the obligation to comply with them.
1.9. Training Participant – a person indicated by the Client in the Booking/Contract who will participate in the Training Lesson. If the Training Participant is to be a person under 18 years of age for whom the provisions of law require the consent of a legal representative to perform legal acts/participate in the training, such consent shall be given by a person authorised to do so prior to STOK conducting the Training Lesson, and moreover such representative should indicate a person who will be authorised to collect such Participant from the Training Lesson.
A Training Participant:
a) shall have no health conditions preventing safe participation in Training Lesson– confirmed by them (or their parent/guardian where required) before the Training Lesson;
b) during participation in the Training Lesson, should have clothing appropriate to the type of training provided and appropriate equipment that is undamaged and in proper working order.
Subject to the subsequent sentence – it is recommended that the Training Participant purchase accident insurance (NNW) (STOK does not provide such insurance). Participants in group classes under “Winter Holidays with Stokuś” in the 2024/2025 season are covered by group insurance (UNIQA).
1.10 Form – an interactive form made available by STOK to the Client. The Form is completed by the Client with the data necessary in connection with the Booking. After the Booking is confirmed by STOK, the Client, via the form made available to them, may confirm the Training Lesson covered by the Booking or cancel it (resign from it).
2. Booking:
2.1. A Conditional Contract is concluded by the Client with STOK in person or via means of distance communication, and its subject-matter is the booking of the Training Lesson selected by the Client from STOK’s offer, connected with the Client’s (Training Participant’s) leisure, which is to be provided on the date specified in the booking. The booking occurs at the moment of its confirmation by STOK. In the case of contact by the Client with STOK by telephone or by email, confirmation of the Booking takes place in email form to the Client’s email address in connection with the Client’s use of the Booking Form (the Client may make changes to the Booking in accordance with the notices made available to them in the Form or in the email message).
2.2. Conclusion of the Contract, the subject-matter of which is a Private Lesson, is conditional upon the Private Lesson covered by the Booking being confirmed and paid for in full by the date specified in the Booking.
2.3. Conclusion of the Contract, the subject-matter of which is a Group Lesson, is conditional upon the Group Lesson covered by the Booking being confirmed and paid for in full by the date specified in the Booking, and upon the formation of the given training group. Such training group is formed when the Group Lesson has been confirmed and paid for in full by the minimum number of persons constituting that group:
a) adult groups need at least 2 people;
b) children's ski groups need at least 3 people;
c) children's snowboard groups need at least 2 people.
2.4. A Booking of a Training Lesson which is subsequently not confirmed and not paid for by the Client within the time limit indicated in the Booking (and, in the case of a Group Lesson, where the training group does not form) does not produce legal effects – i.e. no Contract is concluded for the Training Lesson not paid for within the time specified in the Booking (such Booking is cancelled). In such a situation, STOK is not obliged to provide the training service under that Training Lesson specified in the Booking, and the Client does not incur additional charges for such a booked Training Lesson which has not come into effect. In the event that the training group does not form and such Training Lesson has been paid for by the Client, the amount paid by the Client shall be refunded to them without delay.
3. Contract:
3.1. A Booking for which the conditions for entry into effect have been met, i.e.:
a) for Private Lessons – confirmed and paid by the booking deadline;
b) for Group Lessons – confirmed and paid by the booking deadline, with minimum numbers reached.
3.2. The subject-matter of the Contract is the Training Lesson covered by the Booking, confirmed and paid for in full by the date specified in the Booking, on the terms set out in the Terms and Conditions and in the documents accepted by the Client. The Training Lesson is carried out at a specified time, begins and ends at the hours indicated in the Booking, and therefore the Training Participant should ensure that they arrive at the training location sufficiently in advance (the place indicated in the booking/information provided to the Client). It is hereby clarified that STOK’s performance is connected with the necessity of prior reservation of human resources (Instructors) in order to ensure service by Instructors for Clients in the period of time and at the place specified in the contract.
4. Changing Private Lesson dates:
4.1. The Client may request a change of the date of a Private Lesson no later than 60 minutes before the scheduled start time of that lesson, provided that in the case of lessons starting by 10:00 am, the request to change the date must be addressed to STOK no later than 6:00 pm on the day preceding the scheduled start time of that lesson. The request must be effectively delivered to STOK by email at
biuro@szkolastok.pl, by telephone at +48 18 265 42 80, or in person at the STOK Office. Group Lessons take place in accordance with the established schedule. A change of the date of a Training Lesson from the low season to the high season may involve the Client being obliged to pay the difference in price.
4.2. In the event of unavailability of an Instructor for reasons beyond STOK’s control, or where, due to weather conditions/conditions on the slope, the Training Lesson cannot take place at the date or place set in the Booking, STOK will propose to the Client another date or place for the provision of the Training Lesson.
5. Rules at STOK Ski School
5.1. During Training Lessons, STOK’s Clients (i.e., Training Participants) use the ski lifts out of turn.
5.2. The lesson prices do not include fees for the use of ski lifts by Training Participants. Before the start of the Training Lesson, a ticket must be purchased at the Ski Resort ticket office or at the STOK Office. A ticket tailored to the duration of the classes has been prepared especially for STOK Clients. At the STOK Office, in addition to the generally available tickets, one may purchase—from the Ski Resort—2-hour, 3-day and 5-day passes, tailored to the needs of children taking part in the “Winter Holidays with Stokuś” and “Super Stoker” courses.
5.3. Obtaining information on the availability of Instructors, and the booking and payment of Training Lessons, is possible exclusively through the STOK Office.
5.4. STOK reserves the right to replace the Instructor indicated in the Booking confirmation with another Instructor.
5.5. Training Packages (10+ and 20+) must be paid for in full in advance. The Packages may be used throughout the 2024/2025 winter season (which means that the Training Package may be used, under the rules set out in the Terms and Conditions, within its validity period, i.e. until the end of the 2024/2025 winter season) – on the agreed dates of the Training Lessons. In the case of purchasing a package covering prices in both the high and low seasons, a mixed price will be calculated. The 10+ Package applies to a one-off purchase of from 10 to 19 Training Hours. The 20+ Package applies to a one-off purchase of at least 20 Training Hours.
5.6. The promotional price of Private Lessons for the second and third person applies where the lessons are purchased by a single Client. All persons then learn simultaneously with the same Instructor. Office staff or Instructors may refuse to perform such a service where there is a large difference in age or skills between the lesson participants.
5.7. In the event that the Client (Training Participant), for reasons for which STOK is not responsible, is late for the start of the Training Lesson, the Training Lesson is not extended.
5.8. Training Participants meet the Instructor at specially designated locations. The meeting place with the Instructor and the stand number are indicated in the Booking confirmation.
5.9. Before commencing the lesson, the Client is obliged to provide the Instructor with detailed and truthful information regarding skiing skills, as well as health condition and physical fitness and any ailments – to the extent relevant to the training service being provided, which may affect the training of the Training Participant. The purpose of providing this information is to ensure the Client’s safety and the highest quality of services provided by the STOK Ski School.
5.10. The Training Participant is obliged to report to the Instructor any worrying symptoms during the Training Lesson, in particular: dizziness, pain, bruising sustained. The Instructor decides on the further participation of the Training Participant in the Training Lesson.
5.11. The Instructor may refuse to conduct the Training Lesson where the Training Participant is under the influence of alcohol (or other intoxicants).
5.12. Training Participants who wish the lessons to be conducted within the snowpark area are requested to sign an appropriate statement at the STOK Office.
5.13. The Instructor may refuse participation in the Training Lesson to a Training Participant who does not have appropriate equipment: a helmet (we remind you that children under 16 years of age have a statutory obligation to use helmets), skiing or snowboarding kit, and a pass. In such a case, the School shall not be liable on account of the prevention of participation in the Training Lesson for reasons beyond its control.
5.14. STOK does not provide kit (skis, boots, snowboards, helmets, etc.) and is not liable for the technical condition of sports kit used by Training Participants, subject to point 5.15.
5.15. The Instructor is obliged to check whether the Training Participant’s kit is not defective. In the event that a defect in the kit is found, point 5.13 applies accordingly. The Instructor is not authorised to interfere with the setting of the force required to release ski bindings. In the case of incorrectly adjusted bindings, improperly selected skis or other kit, the Instructor will indicate the nearest ski service or rental shop where adjustment or replacement of the kit will be possible.
5.16. Except in cases provided by law, children may participate in Training Lessons only with the consent of their legal representative (legal guardian) – in accordance with sections 1.8 and 1.9 of the Terms and Conditions.
5.17. During the activities, Instructors are authorised to issue binding instructions to Clients (Training Participants) – including children – as well as to impose orders and prohibitions necessary to ensure the proper course of the lesson and the safety of both the Training Participants and other persons present on the slope. The Instructor may refuse to continue the lesson in the event of the Training Participant’s persistent failure to comply with the instructions issued.
5.18. Criteria for allocation to the “Winter Holidays with Stokuś” groups:
• Orange – beginners aged 5-10;
• Brown – ages 6+, can turn and stop independently, or completed orange level;
• Silver – ages 7+, confident on blue runs and lifts, or completed brown level;
• Gold – ages 9+ who've completed silver level;
• Diamond – ages 10+ who've completed gold level.
5.19. Criteria for allocation to the “Super Stoker” groups:
• Rookie – ages 8+ who can't snowboard;
• Private – can turn independently with controlled skidded turns, or completed rookie level;
• Hotshot – confident on blue runs and lifts, or completed private level.
5.20. Our staff make all group allocation decisions.
5.21. Training Participants will be allocated to a group on the basis of a statement of skill level. The School reserves the right to refuse to continue the course or to transfer the Client to another group if it turns out that the Client’s skills do not correspond to the level of the group to which they were assigned at the beginning of the course.
5.22. The promotional price of Group Lessons for the second and each subsequent person applies where two or more packages are purchased by a single Client. These persons may be assigned to different groups on the basis of their skills or the availability of places in the group.
5.23. The School declares that during the course the Instructors will exercise due diligence in teaching skiing or snowboarding and in imparting knowledge on the correct behaviour of a skier on the slope.
6. Payment
6.1. The Client makes payment in one of the available ways:
a) Online: via a payment link (handled, for example, by PayPro S.A. – Przelewy24, or another online payment system provider with which STOK currently cooperates in servicing such payments);
b) At our office:
– cash;
– card;
– BLIK;
c) Bank transfer (please contact us first);
d) Hotel account (Hotel Bania guests only).
6.2. In the case of payment at the STOK Office, payment of the total price for the Training Lesson covered by the Booking must be made no later than 60 minutes before the start of that lesson, and in the case of lessons starting between 8:00 am and 9:00 am no later than by 6:00 pm on the day preceding that lesson. Before confirming the Booking, the Client is informed of the total price of the Booking. The parties may agree in the Booking on a different date or method of payment.
6.3. In the case of online payment, the Client makes payment via the link made available to them in the course of the Booking (electronic payments). In the case of a Booking in which the start time of the performance of the first service covered by the Booking is later than 49 hours from the moment of creation of the Booking, payment must be made within 48 hours from the moment of creation of the Booking. In the case of a Booking in which the start time of the performance of the first service covered by the Booking is earlier than 48 hours from the moment of creation of the Booking, payment must be made within 1 hour from the moment of creation of the Booking. In the case of a Booking in which the start time of the performance of the first service covered by the Booking is earlier than 1 hour from the moment of creation of the Booking – payment must be made immediately, i.e. no later than 30 minutes before the start time of the service covered by such Booking or within the time limit agreed directly with STOK prior to the start of the service covered by such Booking (i.e. in the case of such arrangements – payment should be made no later than before the start time of the service covered by such Booking). Bookings not paid for within the time limits indicated above are subject to cancellation (appropriate information on cancellation will be provided to the person making the Booking), provided that cancellation of a Booking in which the start time of the performance of the first service covered by the Booking is earlier than 1 hour from the moment of creation of the Booking will be preceded by an attempt by STOK staff to contact the Client. The terms and conditions of the provider(s) of payment services (e.g. PayPro S.A.) apply to the online payment process.
6.4. STOK is not liable for the cancellation of the Booking (failure to conclude the contract) for reasons beyond its control and attributable to the payment service providers through whom it carries out the payment process for the Booking, unless the provisions of law provide otherwise in the given case.
6.5. Information on the current prices of the services offered by STOK, as well as the duration of the low season and the high season, has been provided on the Website (szkolastok.pl) in the Price List tab. The prices given include VAT. STOK reserves the right to change prices at any time on the terms set out in the following sentences. Price changes apply from the moment of their express indication and placement on the Website in the Price List tab. The previous prices set out in the Price List placed on the Website (in force at the time of conclusion of the contract) apply to contracts concluded prior to the change of prices – therefore the change of prices will not concern contracts that were concluded earlier. The rules for issuing and using the loyalty card entitling the holder to a discount are set out in a separate set of terms and conditions.
6.6. —
6.7. The Client may submit a request for a VAT invoice within the time limit provided for by law.
7. Complaints
7.1. The Client has the right to submit a complaint.
7.2. Send complaints to
biuro@szkolastok.plor in writing to our office.
7.3. Include your booking/contract number, describe the issue and what you'd like us to do.
7.4. We'll respond within 14 days of receiving your complaint.
7.5. Information on the consideration of the complaint will be provided to the complainant in the same manner in which it was submitted. In the event of the complaint being upheld, STOK will satisfy the complainant’s demand in accordance with the rights to which they are entitled.
7.6. We handle all complaints in accordance with the law.
7.7. The above provision also applies in the case of a complaint concerning a service provided by electronic means.
8. Withdrawal from the Contract / cancellation of the Training Lesson covered by the Booking
8.1. STOK informs that in the case of a Booking of a Training Lesson – a service connected with leisure, on a date strictly specified in the contract – the right to withdraw from such a contract, pursuant to Article 38 point 12 of the Act of 30 May 2014 on consumer rights, does not belong to the Client.
8.2. [STOK clarifies that the Client may cancel a Training Lesson covered by the Booking that has not yet been performed no later than 1 hour before the scheduled start time of that Lesson. In such a case, the payment for that Training Lesson will be refunded to the Client.]
8.2. Without prejudice to the rights provided for by law, subject to the provisions of paragraphs 8.3–8.5 below, the Client is granted a contractual right to cancel a Training Lesson covered by the Booking that has not yet been performed no later than 1 hour before the scheduled start time of that lesson, which must be reported to STOK within that time limit – in such a case the payment concerning that service (the appropriate part of the payment, if the Booking covered more than 1 Training Lesson) will be settled between the Parties in accordance with the provisions of law (Article 750 of the Civil Code in conjunction with Article 746 of the Civil Code), taking into account that the refund for the unperformed Training Lesson will be made in accordance with the principle of proportionality (i.e. that the cancellation of 1 hour of a Training Lesson will be connected with the refund of the payment relating to that 1 hour of the Training Lesson from the perspective of the Booking made and the applicable price list).
8.3. In the case of Training Packages, the Client is entitled to a refund of the price for unused Training Lessons within the validity period of the Training Package only until the end of the season for which the Training Package was purchased, taking into account the principle of proportionality and the applicable price list – the above being without prejudice to the right to a refund in respect of Training Lessons that did not take place for reasons attributable to STOK.
8.4. It is clarified that in the event of cancellation of Training Lessons not yet performed under a Booking covering promotional prices (the 10+ Package, promotional prices for the second and subsequent person, etc.), the Client loses the right to benefit from the promotional price.
Example no. 1: If the Client purchased 20 Training Hours under the 20+ Package and 1 Training Hour remains unperformed, the transaction will be settled taking into account the 10+ Package price, which means that the Client will be entitled to a refund of the difference between the price for 19 h under the 10+ Package and the price for 20 h under the 20+ Package.
Example no. 2: If the Client purchased 1 Training Hour for 2 persons and cancels the training in respect of 1 person, the amount refunded is the price taking into account the discount for the second person, i.e. there is no calculation of an average Booking price per person.
8.5. In the event of cancellation of training activities not yet performed under “Winter Holidays with Stokuś”, the Client is entitled to a proportional refund for the unused parts of the training programme that make up the entire programme.
9. Types and scope of services provided by electronic means, conditions for the provision of services by electronic means
9.1. STOK provides the following services via the Website: a service enabling familiarisation with the information found on the web pages on the Service (use of the web pages); a service enabling the conclusion of a contract online (at a distance) in connection with making the Booking Form available to the Client. The service recipient may use the services available through the Service, subject to meeting the technical conditions of the ICT system referred to below.
9.2. A condition for the proper use of the services on the Website is that the Client has an ICT system meeting the following minimum technical requirements:
a) Internet connection;
b) an installed web browser: Mozilla Firefox version 4.0 or newer, Google Chrome version 6.0.3809.46 or newer;
c) JavaScript enabled;
d) active email account.
9.3. A condition for the use of the services is enabling the use of cookies. Detailed information about the cookies used on the Website, including in the provision of services, is available in the STOK Website Privacy Policy.
9.4. It is prohibited for the service recipient to provide content of an unlawful nature, as well as untrue information.
9.5. STOK provides access to up-to-date information on specific risks associated with the use of a service provided by electronic means; and on the function and purpose of software or data not being a component of the content of the service, introduced into the ICT system used by the Service Provider, at the request of the Service Recipient submitted by electronic means to the Service Provider’s electronic address.
10. Personal data protection
10.1. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”), data obtained in connection with activities related to the provision of services by electronic means or the conclusion of a distance contract are processed by STOK, which is the controller of such data.
10.2. The rules for the processing of personal data are set out in detail in the document: STOK Website Privacy Policy, which the Client is obliged to read when making a Booking. This document is also available on the Website.
11. Disputes
In the case of disputes involving a Consumer, it is possible to use out-of-court methods of handling complaints and pursuing claims. In such a situation, the Consumer may request the intervention of an ombudsman or use mediation (provided that STOK consents to such mediation). Access to these procedures is described in the Code of Civil Procedure and the Act on Competition and Consumer Protection. Details on the methods and access to out-of-court forms of dispute resolution are also available on the Office of Competition and Consumer Protection website at:
http://www.uokik.gov.pl/spory_konsumenckie.php. STOK also informs that there is an online dispute resolution platform between consumers and traders at EU level (the ODR platform) at:
https://ec.europa.eu/consumers/odr– in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013.
12. Final provisions
12.1. The Client is obliged to read and comply with the Terms and Conditions.
12.2. Pursuant to the principles described in Article 81 of the Act on Copyright and Related Rights, the image of the Training Participant may be disseminated free of charge in connection with participation in training or events organised by STOK, including together with the images of other persons or with an appropriate description, for STOK’s information, promotional and marketing purposes, on STOK’s website, STOK’s social media portals and in other materials of both an electronic, printed or video nature, without time or territorial limitations – in a manner that does not infringe that person’s rights. Pursuant to Article 81(2)(2) of the Act on Copyright and Related Rights, no permission is required for the dissemination of the image of a person who constitutes only a detail of a whole such as, inter alia, a gathering, landscape, or public event.
12.3. The information provided on the web pages in the Service, in particular announcements, advertisements, price lists and other information, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
12.4. In matters not regulated in these Terms and Conditions, the provisions in force in the territory of the Republic of Poland shall apply, in particular the Civil Code, the Act on the provision of services by electronic means, and the Act on consumer rights.
12.5. STOK reserves the right to amend these Terms and Conditions on the terms set out in the following sentences. Amendments to the Terms and Conditions apply from the moment they are expressly indicated and placed on the Website. The previous Terms and Conditions (in force at the time of conclusion of the contract) apply to contracts concluded before the amendment of the Terms and Conditions – therefore the amendment of the Terms and Conditions will not concern contracts that were concluded earlier.
12.6. All information, data and materials made available on the Website (including, inter alia, names, logos, the price list, as well as graphics, colour scheme and site layout) and all other intangible property rights related to the content of the Website, including, inter alia, works and rights to trademarks, belong to STOK or to entities with which STOK has concluded appropriate Contracts and are protected by copyright, trademark rights, database rights or other intellectual property rights.
12.7. These Terms and Conditions enter into force on 01.01.2025.
The Terms and Conditions are protected by law on the basis of the provisions of the Act of 4 February 1994 on Copyright and Related Rights (Dz.U.2017.880 consolidated text of 2017.05.05 as amended).
